Family Law

Divorce Attorney and Family Law Practitioners

Family law disputes are some of the most painful and personal legal problems a person can face. From divorce and child custody issues, to adoptions and domestic violence, the issues involved in family law are often emotional and difficult to deal with. At The Windley Law Firm, our family law attorneys understand that working with a client includes taking the time to get to know their situation and their goals for the future. We work hard to help people manage their family related legal problems.

Many of the issues that arise in family law are related to divorce. Child custody, child support, enforcement of child support, support and custody modifications, division of marital property, and more are legal issues that may surround a divorce decree. Whether you are being sued for divorce, or you want to file for divorce, you need a divorce attorney who is dedicated to protecting your interests and getting you through this difficult time.

We also handle non-divorce related family law concerns, including paternity actions, adoptions, restraining orders, domestic violence issues, terminations, child protective services matters, and more. We provide full service family law representation.

We have more than thirty years of combined experience helping people deal with their legal problems. While many family law disputes are resolved in mediation or in a settlement agreement, we are not afraid to go to court and fight for our clients. Every situation is different and requires a flexible approach to ensure that everything is handled properly.

Additional Information on Uncontested Divorce

Going through a divorce is emotionally and economically draining. It can also be confusing and time consuming without the appropriate legal assistance. The Windley Law Firm offers a simple and inexpensive alternative for people going through uncontested divorces in Texas. With the help of one of our experienced lawyers, you will be able to maneuver through the legal system and will be equipped with the well drafted legal documents you need. Using online forms and “do if yourself” divorce kits may result in costly mistakes that can be avoided when you have an attorney from The Windley Law Firm draft your documents for you.

Residency Requirement in Texas:

In order to be granted a divorce in Texas, you must first meet the residency requirement. At least one spouse must have been living in Texas for the past six (6) months or longer, and the spouse filing for divorce (the Petitioner) must have lived in the county where the suit is being filed for the past ninety (90) days or more.

What is an Uncontested Divorce?

If you believe that you and your spouse are in agreement or will be in agreement on each and every element of your divorce, including: division of property including all assets and liabilities, conservatorship of children (child custody), support payments, etc, then you are a candidate for an uncontested divorce. You and your spouse must be willing to work together to negotiate through the terms of your divorce. If, however, you are unable to reach an agreement on any particular issue, you may be facing a contested divorce. For contested divorces, please call our office at (972) 420-6560 and set up a divorce consultation with one of our attorneys.

Why Should I use an Uncontested Divorce?

Often times, contested divorces end up depleting a large amount of the community resources due to attorney and other fees. This could end up leaving less money available to be divided amongst you and your spouse than perhaps the value of assets you may be fighting over. Additionally, uncontested divorces can be completed quickly, easing the emotional pain of dragging out a divorce.

I was involved in a child custody case. I felt like Elizabeth, my attorney, understood my frustrations and helped guide me throughout the process. It was my first time working with an attorney and she was able to explain everything in plain mans language. Her attitude was very reassuring. The responding time was amazing. Her legal team is also super polite and helpful. Hoping to never need another attorney but I know that if another situation arises, I’ll have the best there is!

“Although I didn’t get to meet Kylee in person, I feel like she and I worked together the most throughout all of this. She has always been on point, prepared, and assisted me with whatever questions I had about navigating through all of this. I know I had a lot of repetitive call and emails, but she was always patient with me and got me to the right place. The firm is lucky to have a paralegal like you that is always there for the clients.”

JANE • ATTORNEY

“I was apprehensive about how my case was going to get handled… but Elizabeth showed up and worked with me like I had been working with her for the last two years of my case. She remained calm, cool, and collected, and walked me through what was arguably the most difficult part of all of this. I’m so thankful someone like her was the one who showed up and got us to where we landed yesterday. After everything was said and done, I feel like I got a favorable outcome because of her guidance and patience with me.”
